DMCA Policy

cliptide respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, we will respond to valid notices of claimed copyright infringement submitted to our designated agent.

1. Filing a Takedown Notice

If you believe content available through the Service infringes your copyright, please send a written notice to our designated agent that includes all of the following:

(a) a physical or electronic signature of the copyright owner or an authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to let us locate it (such as a URL); (d) your contact information, including address, telephone number, and email; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

2. Counter-Notice

If content you posted was removed in response to a DMCA notice and you believe the removal was a mistake or a misidentification, you may submit a counter-notice containing: (a) your physical or electronic signature; (b) identification of the material that was removed and the location where it appeared before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and (d) your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal court in the district where you live (or, if outside the US, any judicial district in which cliptide may be found) and that you will accept service of process from the party who filed the original notice.

3. Repeat-Infringer Policy

cliptide will, in appropriate circumstances and at our sole discretion, disable and terminate the accounts of users who are determined to be repeat infringers. We track valid DMCA notices against accounts and may take action even without a final judicial determination of infringement.

4. False Claims

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages. Please do not submit false claims.
